ImagineCare USA, Inc (collectively, "ImagineCare" or "We") respect your privacy and are committed to protecting in through our compliance with this policy.

    Purpose. The purpose of this Privacy Policy is to describe how ImagineCare collects, uses, maintains, protects, and shares information about you through mobile applications you download from the www.imaginecare.com website or from the commercial application store appropriate for your device, including the ImagineCare application (referred to herein as the "App"). Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it.     Our Privacy Policy explains:

    Scope. This Privacy Policy applies only to information we collect through the App, and certain ImagineCare affiliated sites accessible through the App or online, such as my.imaginecare.com and enroll.imaginecare.com. This policy does not apply to any information collected by us offline or through any other means. Some of our affiliated websites, such as http://imaginecare.com, are governed by their own separate privacy policies. Our App may also contain links to third party sites that are not owned or controlled by ImagineCare. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our App and to read the privacy statements of each and every website that collects personal information.

    Other Privacy Policies. Your information may be subject to additional privacy practices such as the Health Insurance Portability and Accountability Act of 1996 (HIPAA) as amended by the Health Information Technology and Economic and Clinical Health Act of 2009 (HITECH Act).

    Terms of Use. Please note that your use of our App is also subject to our End User License Agreement.


    Information You Provide to Us

    We collect information you provide to us, for example when you create or modify your account, register to use the App, request devices or services from us, request information from us, contact customer support, or otherwise communicate with us. This information may include: Name, Home and Shipping Address(es), Email address, Home, Work, and Mobile Telephone number(s), Date of Birth, Sex, Gender, Hobbies and Interests, Primary Language, Physical and/or Mental Impairments, Marital Status, Education Level, Residence Type, Insurance Provider, Names and Contact Information of Your Health Care Providers, Names and Contact Information of Your Friends or Family Caregivers, and Religion and Religious Beliefs.

    Information We Collect Through Your Use of Our App

    Google Analytics

    We use Google Analytics, a web analytics service provided by Google, Inc. ("Google") to collect certain information relating to your visit to our informational website, www.imaginecare.com. This information may include details of your visit to the website, including location data, the pages that you view, and information about your computer and internet connection, including your IP address, operating system, and browser type. Google Analytics uses "cookies," which are text files placed on your computer, to help us analyze how users use the site.     Information Collected Through Cookies and Similar Technologies

    We and our service providers use cookies and other technologies to receive and store certain types of information whenever you interact with our App through your mobile device. A cookie is a small file containing a string of characters that is sent to your mobile device when you visit a website or use an application. Cookies may store unique identifiers, user preferences and other information. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some App features or services may not function properly without cookies. We use cookies to improve the quality of our service, including for storing user preferences and for tracking user trends. We remove these cookies when you log out or close the App.

    Geolocation Data

    We may also automatically collect location and/or geolocation data through your mobile device. This information may be used to improve the quality of services, to direct you to services available in your area, or to collect data on your activity levels. You may enable or disable this feature through your mobile device's "Settings."

    Other data collection technologies

    The App may also collect information through Crashlytics, a mobile app analytics service, to log crashes and other non-fatal errors that may occur during the use of the App. Information collected may include what you were doing at the time of the crash or error, and any searches or search terms that you performed during your use of the App. This data is not identifiable to your ImagineCare account and helps us improve our App.

    No Information From Children Under Age 13

    Our App is not intended for children under 13 years of age. No one under age 13 may provide any information on the App. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information in the App or through any of its features, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please call us at 844-346-2446.


    To Provide Devices, Services, and Information. We collect information from you so that we can provide devices and services that you request using the App, and provide information that you request from us. We use your personal information to contact you about your device orders and to ship devices to you, and to connect you to medical support services when needed. We may send you newsletters, information about devices and our services, new offerings, and/or other promotional material. We may also use your information to administer surveys we conduct from time to time to understand our users' needs.

    Sharing with Third Parties. We may provide information to third party service providers that help us operate and manage the servers used for our App, process orders, and fulfill and deliver devices and services that you request from us. We may share your information with third party service providers to provide phone and video chat support. These service providers will have access to your personal information in order to provide these services, but when this occurs we implement reasonable contractual and technical protections to limit their use of that information to help us provide the service.

    Advertising. We do not use your activity on the App to show you ads for ImagineCare or for other third parties. We do not belong to any ad networks that use your browsing history across websites to show you interest-based advertisements, and we do not use any cookie technology designed to track you after you leave the App.

    Electronic Health Records Integration. If you are a patient of a health care provider that provides an Electronic Health Records (EHR) integration, we may transmit the information we collect to the EHR system so your health care provider has a more complete health record.

    Your Consent. In addition to the sharing described elsewhere in this Policy, we will share personal information with companies, organizations or individuals outside of ImagineCare when we have your consent to do so. Except as set forth in this Privacy Policy and/or the EULA, we require opt-in consent for the sharing of any sensitive personal information with the individuals or organizations you specify. Sensitive personal information is a particular category of personal information such as confidential medical facts and health information, racial or ethnic origins, political or religious beliefs or sexuality. If you are a patient of a health care provider that provides an Electronic Health Records (EHR) integration, we may transmit the information we collect to the EHR system so your health care provider has a more complete health record.

    Legal Proceedings. We will share personal information with third party companies, organizations or individuals outside of ImagineCare if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to: (a) Meet any applicable law, regulation, subpoena, legal process or enforceable governmental request; (b) Enforce applicable Terms of Use, including investigation of potential violations; (c) Detect, prevent, or otherwise address fraud, security or technical issues; or (d) Protect against harm to the rights, property or safety of ImagineCare, our users, customers or the public as required or permitted by law.

    Emergency Services. We may share personal information with emergency services, including, without limitation, 911, your local police department or fire department, or a health care provider, if we have received information that we reasonably believe indicates that there is an immediate threat of life or safety to you or others.

    Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business or the App to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your personal information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the applicable privacy policy unless you agree differently.

    Aggregated Information. We may disclose aggregated information about our users, and other information that does not identify any individual, without restriction.


    You can access and update certain information we have relating to your online account by signing into your account and going to the Profile section of our App. If you have questions about personal information we have about you or need to update your information, you can Contact Us, or through telephone, email, or U.S. mail at the contact information below. You can opt-out of receiving marketing and promotional e-mails from ImagineCare by using the opt-out or unsubscribe feature contained in the e-mails.

    You can close your online account by contacting us via email, phone, or mail at the contact information below and requesting that we close your account. If you close your account, we will no longer use your online account information or share it with third parties. We may, however, retain a copy of the information for archival purposes, and to avoid identity theft or fraud.


    We use industry standard physical, technical and administrative security measures and safeguards to protect the confidentiality and security of your personal information. However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that e-mails and other communications you send to us through our App or otherwise are not encrypted, and we strongly advise you not to communicate any confidential information through these means.


    If you are a resident of the European Economic Area (EEA), in order to provide our App, devices and services to you, we may send and store your personal information (also commonly referred to as personal data) outside of the EEA, including to the United States. Accordingly, your personal information may be transferred outside of the country where you reside or are located, including to countries that may not or do not provide the same level of protection for your personal information. We are committed to protecting the privacy and confidentiality of personal information when it is transferred. Where such transfers occur, we take appropriate steps to provide the same level of protection for the processing carried out in any such countries as within the EEA to the extent feasible under applicable law. By using and accessing our App, users who reside or are located in countries outside of the United States agree and consent to the transfer to and processing of personal information on servers located outside of the country where they reside, and that the protection of such information may be different than required under the laws of their residence or location.


    Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your consent in accordance with applicable law. We will make any privacy policy changes available on our website's Privacy Policy Page. If the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of privacy policy changes). We will also keep prior versions of this Privacy Policy in an archive for your review. Your continued use of the App after we make changes is deemed to be acceptance of those changes.
